By accessing or using Host-Tracker, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the Service.

1Definitions
- "Company"
- means Host-Tracker, the provider of the Service.
- "Service"
- means the website monitoring and related services provided by the Company at host-tracker.com.
- "User" or "you"
- means any individual or legal entity that registers for or uses the Service.
- "Subscription"
- means a paid plan that grants the User access to specific features of the Service for a defined period.
- "Account"
- means the User's registered profile on the Service.
2Acceptance of Terms
2.1.By creating an Account or using the Service, you confirm that you are at least 18 years of age or have the legal capacity to enter into a binding agreement in your jurisdiction.
2.2.If you are using the Service on behalf of a legal entity, you represent that you have the authority to bind that entity to these Terms.
2.3.The Company reserves the right to update or modify these Terms at any time. Where reasonably practicable, the Company will provide advance notice of material changes at least 14 days before the changes take effect, via email to the address associated with your Account and/or a prominent notice within the Service. Continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Service before the effective date and may request Account termination.
3Acceptable Use Policy
3.1.You agree to use the Service only for lawful purposes and in accordance with these Terms.
3.2.You must NOT use the Service to:
- a)engage in any activity that is illegal, fraudulent, or harmful under applicable law;
- b)conduct or facilitate cyberattacks, denial-of-service attacks, or any form of destructive activity against any system or network;
- c)transmit malware, viruses, or any malicious code;
- d)harass, threaten, or harm any individual or organization;
- e)violate the intellectual property rights of any third party;
- f)attempt to gain unauthorized access to the Service, its infrastructure, or other users' accounts;
- g)use the Service in any way that could impair its performance, availability, or integrity.
3.3.The Company reserves the right to suspend or terminate access for any User who violates this Acceptable Use Policy, without prior notice and without liability.
4Account Registration and Security
4.1.You are responsible for maintaining the confidentiality of your Account credentials.
4.2.You are solely responsible for all activities that occur under your Account.
4.3.You must notify the Company immediately at ht2support@host-tracker.com upon becoming aware of any unauthorized use of your Account.
4.4.The Company will not be liable for any loss or damage arising from unauthorized access to your Account due to your failure to protect your credentials.
5Subscription and Payment
5.1.Access to premium features of the Service requires a paid Subscription.
5.2.All fees are stated in US dollars unless otherwise indicated. Applicable taxes may be added at checkout depending on your jurisdiction.
5.3.Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). By subscribing, you authorize the Company to charge your payment method on each renewal date.
5.4.The Company reserves the right to change pricing. Users will be notified at least 30 days before any price change takes effect for existing subscriptions.
5.5.Failure to pay may result in downgrade to a free plan or suspension of the Account.
6Refund Policy
Full unconditional refund available within 30 days of payment.
6.1.The Company offers a full, unconditional refund within 30 days of the payment date if the User is not satisfied with the quality of the Service. The refund amount is limited to the most recent billing period payment only.
6.2.To request a refund, the User must contact the support team within the 30-day window. Refunds requested after this period are not guaranteed and will be considered at the Company's sole discretion.
6.3.Refunds are processed to the original payment method within 5–10 business days.
7Service Availability and Suspension
7.1.The Company strives to maintain a high level of Service availability but does not guarantee uninterrupted access. Scheduled and emergency maintenance may occur with or without prior notice.
7.2.The Company reserves the right to suspend or terminate the Service, in whole or in part, at any time for any reason, including but not limited to: violation of these Terms, suspected fraudulent activity, technical requirements, or business decisions.
7.3.In the event of suspension or termination not caused by the User, the Company will make reasonable efforts to notify the User and offer a prorated refund for unused prepaid subscription time.
7.4.Force Majeure: The Company shall not be liable for any failure or delay in providing the Service resulting from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, floods, fires, earthquakes, epidemics or pandemics, war, terrorism, civil unrest, government actions or regulations, internet or telecommunications infrastructure outages, power failures, third-party data center failures, or any other event of force majeure. The Company's obligations under these Terms are suspended for the duration of such an event. The Company will make reasonable efforts to notify Users of force majeure circumstances and to restore the Service as soon as practicable.
8Limitation of Liability
8.1.TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITIES, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
8.2.THE COMPANY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SUBSCRIPTION IN THE MOST RECENT BILLING PERIOD PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
8.3.THIRD-PARTY SERVICES: The Company integrates with or relies upon third-party services including, but not limited to, payment processors, SMS and email notification providers, DNS lookup providers, and infrastructure providers. THE COMPANY SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, OR DISRUPTION CAUSED BY THE ACTIONS, ERRORS, OUTAGES, OR FAILURES OF SUCH THIRD-PARTY SERVICES. Your use of third-party services is governed solely by the terms of those respective providers.
8.4.The limitations set forth in this Section apply regardless of the legal theory upon which the claim is based, even if the Company has been advised of the possibility of such damages.
9Disclaimer of Warranties
9.1.THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9.2.The Company does not warrant that the Service will be error-free, secure, or continuously available; or that any defects will be corrected.
10Intellectual Property
10.1.All intellectual property rights in the Service, including software, design, trademarks, and documentation, are owned by or licensed to the Company.
10.2.These Terms do not grant you any rights to use the Company's intellectual property other than the limited right to access and use the Service as described herein.
10.3.You retain ownership of all data you submit to the Service. By submitting data, you grant the Company a limited, non-exclusive license to process that data solely for the purpose of providing the Service.
11Confidentiality and Privacy
11.1.The Company does not sell, rent, or disclose personal information provided by the User upon registration to any third parties, except as required to deliver the Service or as required by law.
11.2.The Company logs information about pages and features accessed by Users to improve Service functionality. Details are outlined in the Privacy Policy available at host-tracker.com/privacy.
11.3.The Company uses cookies for user identification, authentication, and to enhance user experience. Users may manage cookie preferences through their browser settings.
11.4.Your use of the Service is also governed by the Company's Privacy Policy, which is incorporated into these Terms by reference.
12Termination
12.1.You may terminate your Account at any time by contacting the support team at ht2support@host-tracker.com. Account deletion is performed by the Company upon request and is not available as a self-service feature.
12.2.The Company may terminate or suspend your Account at its sole discretion, with or without cause, with or without notice.
12.3.Upon termination, your right to use the Service ceases immediately. Sections 8, 9, 10, and 13 survive termination.
13Governing Law and Dispute Resolution
13.1.These Terms shall be governed by and construed in accordance with applicable international commercial law principles and the laws of the jurisdiction in which the Company is incorporated.
13.2.Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties.
13.3.If negotiation fails, disputes shall be submitted to binding arbitration or the competent courts of the Company's jurisdiction of incorporation.
14General Provisions
14.1.Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Service.
14.2.Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
14.3.Waiver: Failure by the Company to enforce any right or provision of these Terms shall not constitute a waiver of that right.
14.4.Assignment: You may not assign your rights under these Terms without prior written consent of the Company. The Company may assign its rights without restriction.
